I am not a lawyer, I am a judgment referral expert (Judgment Broker). This article is based on my experience in California. Laws vary in each state, and nothing in any of my articles should ever be considered legal advice. This article is my opinion about how to work around the problem of debtors having common names, or using the same names or Social Security Numbers of their parents, grandparents, or kids.
When a kid is named Barry Clark and his father is also named Barry Clark and his grandfather is named Barry Clark; it is perhaps cute, perhaps sentimental, and perhaps it can make it more difficult for creditors to collect from the right Barry Clark. It is too bad that dates of birth, and at least partial Social Security Numbers are not put on most judgments by courts.
Some debtors use a relative’s Social Security Number, or one from an unrelated person, to evade creditors. Even if your debtor is a “scammer” and uses someone else’s or multiple Social Security numbers, there is not much you can do about it.
In theory, intentionally using someone else’s or multiple Social Security Numbers (SSNs) is illegal. However, in real life – unless one uses multiple SSNs to defraud the government, a big business, or a VIP – law enforcement rarely does anything to the average person who uses fake SSNs – or even those who commit perjury.
Making threats is illegal. One cannot threaten, or threaten to notify others, for example the police or the IRS, for the purpose of getting a judgment paid.
There are many laws that restrict disclosing information about a debtor’s debt to third parties. What happens when you have a judgment debtor whose name is the same as his father’s name? If you mail them a letter or anything else, how do you know the right person will open it? If you call them to negotiate a payment plan, how do you know you are talking to the right person?
This same-named debtor problem occurs fairly often. If you know the age of the debtor, perhaps their middle name is different. When you call or write, use their middle name, or use Jr. or Sr. If they ask why you want to talk to the debtor, say it is a business transaction.
If the debtor says they are the right person (the person named on the judgment), make sure they sound “right”, a 22-year old should sound different than a 50-year old. If you are sure you are speaking to the right person, recite the “Mini-Miranda”, and ask them how they plan to repay this judgment debt.
Google “Mini Miranda”. When speaking with the debtor, you need to recite the Mini Miranda to them. Also include the Mini Miranda (and in California, the Rosenthal Act) on your first written correspondence to the judgment debtor (for example a payment plan agreement letter).
Then, prepare to hear lies, including what a SOB the original judgment creditor was, how they were not served, how they are poor, and be sad, mad, etc. There is a 10% chance they will offer to pay you, and a 2% chance they will really pay you as they promised.
If you call a judgment debtor, never lie about who you are, and do not let them believe you are associated with any entity that you are not part of. It is ok to tell them you are an investigator with your own company. Tell them that you are trying to contact (debtor’s name).
You can proceed with your investigative call by saying “we need to confirm that we are speaking with the correct individual, can I kindly ask you for your year of birth?” As a first step, you are just trying to confirm that you have the correct individual.
Once you have confirmed that you are speaking with the correct debtor, try being nice and working with them on a payment plan. You might say they qualify for a voluntary payment plan instead of normal enforcement procedures.

Ever notice how hungry you feel when you don’t get enough sleep? Did you know that when we are sleep-deprived we eat more because we are actually hungrier? Yes, it’s true. According to a 2006 study of over 68,000 women from the Case Western Reserve University in Cleveland, women who slept less than five hours a night were 32 percent more likely to gain 33 pounds or more over the 16-year study period than women who slept at least seven hours a night. The bottom line: the more you sleep, the better your body can regulate the chemicals that control hunger, fullness and fat storage.
Sleep is often the first thing we give up when we are short on time. With increasing stress, intense deadlines and 24/7 connectivity via cell phones and the internet, it seems there just aren’t enough hours in the day. And yet, adequate sleep is one of the most important aspects of weight maintenance and good health.
So, just how much sleep do we need? While there are no hard and fast rules and individual needs may vary, the National Sleep Foundation recommends that most adults get seven to nine hours of sleep per night. The amount of sleep you need may be more or less;it’s the amount you need to feel rested, refreshed and alert.
You can make sleep (and weight loss) a higher priority by improving your sleep habits with the following strategies:
1) Work with your circadian rhythms. While most of us can’t go to bed when the sun is setting, we can aim to go to bed as early as possible, set a bed time we can adhere to and begin calming down and dimming lights to aid our bodies sleep-producing hormonal system.
2) Maintain a quiet, dark and comfortable environment for restful sleep. Consider black-out shades if the room has too much light.
3) Reduce your consumption of stimulants such as caffeine, chocolate and nicotine early in the day.
4) Notice if certain foods, vitamins, medications and alcohol affect your getting a restful night’s sleep and adjust if need be.
5) Adjust habits such as exercising late in the day or stimulating activity in the evening if you are having difficulty getting quality sleep.
6) Try journaling during the day or early in the evening to reduce overwhelm and anxiety. Put to paper feelings and thoughts that are troubling, even if they are chronic. Remind yourself you can think of them tomorrow and that you have control over you mind.
7) Try natural sleep aids such as Valerian root and herbal teas and
Consult your health-care practitioner if you are experiencing chronic insomnia, which can be the result of a medical or psychological illness.
Just like eating, sleep is a natural, life-sustaining process. Try to make sleep a priority and schedule it just like you would any other activity. Otherwise, the sleep you lose may lead to the pounds you gain.

When a company such as Samsung manufacture a flash chip, it must meet a certain standard to be classed as Tier 1 or Grade A, it is rated on criteria such as read/write speed and actual memory capacity. If the chip doesn’t meet these standards then it is possible to use software to downgrade the chip to the memory size below, for example: a 2GB memory chip with low capacity will be downgraded to a 1GB chip with full capacity.
The problem with downgrading the chips is that it hides floors in the USB, it may appear to be a working 1GB USB, but there is a much higher chance that there will be problems when transferring files and the chip is much more likely to fail. The problems usually occur when you try to transfer across large files and the transfer is interrupted half way through.
Recycled memory is also not to be confused with a recycled USB Flash Drive where the recycled refers to the casing, NOT the electrical components inside. This type of flash drive is very much welcomed as it is good for the environment, but doesn’t affect the performance of the USB.
When ordering USB Flash Drives from companies in the US or Europe, you are unlikely to encounter these sort of problems as these companies would soon get a bad reputation and a bad reputation is hard to hide in this age of the internet. Companies that go direct to the factory in China with no way to check the quality of the USB’s until they arrive to them are more susceptible to this sort of problem as they have almost no legal come back against the factories. The pricing may be a lot lower, but the quality of the USB Flash Drive you receive can be a lottery. It is a shame that these cowboy factories give the legitimate factories a bad name.
